1. Acceptance of Terms
By creating an account or using GYMpays's website or app, you agree to these Terms & Conditions. If you do not agree, please do not use our service.
2. What GYMpays Is
GYMpays is a payment and attendance-tracking platform. We are not a gym operator — we partner with independently owned and operated gyms. Your gym membership, the equipment, trainers, and facilities are provided solely by the partner gym, not by GYMpays.
3. Membership & Payment
When you join a partner gym through GYMpays, you pay the gym's membership fee for the plan and membership length you select, plus a GYMpays service fee calculated as a percentage of that gym fee. The percentage for each length is listed in section 4. This service fee is non-refundable and covers the cost of running the attendance-tracking and refund programme.
4. Refund Eligibility
The service fee, refund and attendance requirement depend on the membership length you buy:
- 1 Month (30 days): 10% service fee; a refund of 25% of the gym fee after 20 valid attendance days.
- 3 Months (90 days): 10% service fee; a refund of 50% of the gym fee after 59 valid attendance days.
- 6 Months (182 days): 10% service fee; a refund of 50% of the gym fee after 120 valid attendance days.
- 1 Year (365 days): 10% service fee; a refund of 50% of the gym fee after 240 valid attendance days.
- You become eligible for a refund once you record the number of valid attendance days required for your membership length, within your membership period.
- The refund is the percentage of the gym fee you paid for your selected plan (excluding the service fee) that applies to your membership length.
- A valid attendance day requires a successful check-in via QR code, GPS, or staff verification, with a minimum session length as specified in the app. Multiple visits in one day count as a single day.
- Refunds are paid out to the UPI ID you provide and are typically credited within 3–5 working days of your claim.
- If you do not reach the required attendance days within your membership period, you are not entitled to a refund for that period.
5. Attendance Verification
GYMpays uses location data, QR scans, and/or staff confirmation to verify attendance. Attempting to falsify check-ins (e.g. spoofing location) is a violation of these Terms and may result in forfeiture of your refund and termination of your account.
6. Cancellation & Termination
You may stop using the service at any time. Membership fees already paid to a partner gym are governed by that gym's own cancellation policy. GYMpays may suspend or terminate accounts that violate these Terms.
7. Limitation of Liability
GYMpays is not responsible for injuries, losses, or disputes arising from your use of a partner gym's facilities, equipment, or staff. Our liability is limited to the service fee paid to us. We do not guarantee gym availability, equipment condition, or trainer quality at partner locations.
8. Changes to These Terms
We may update these Terms from time to time. Continued use of the service after changes are posted constitutes acceptance of the revised Terms.
9. Governing Law
These Terms are governed by the laws of India, and any disputes will be subject to the jurisdiction of the courts in Jaipur, Rajasthan.
